Recap: Executive orders and Information as it relates to New York States Service of Process
On March 7th, Governor Cuomo issued Executive Order 202.7 which permits remote notarization
On March 20th 2020 Governor Cuomo issued Executive Order 202.8 Extending anything relating to statutory time was tolled through April 19th,2020
On March 22nd, 2020 the Chief Administrative Judge of the Courts ordered that “no papers shall be accepted for filing by a county clerk or a court in any matter of a type not included on the list of essential matters.” This directive is effective immediately and until further order and applies to both paper and electronic filings. The Chief Justices Order here lists what is considered “essential matters.” Persons who believe that a specific pending or new matter should be included in this highly restrictive “essential matters” group should apply to the court for this designation by emergency application by order to show cause, including a detailed explanation of the applicant’s rationale.
No new cases or documents are being filed unless they are listed as essential matters.
NYSPPSA, reached out to New York State’s Empire State Development office to determine if Process Servers and Process Serving Agencies are considered “essential business” during the COVID-19 pandemic.
The reply ensured that process servers and agencies are considered an “essential business,” process servers can continue to serve if they choose to. However, many agencies in order to protect their servers and no spread the corona-virus are only serving essential cases or cases that are necessary to maintain the timing or integrity of the case.

On April 7th 2020 , Governor Cuomo issued Executive Order 202.14 Extending the order which states anything related to statutory time has been tolled until May 7, 2020. The entire executive order is linked below. And that “all in-person business restrictions and workplace restrictions will be effective until 11:59 p.m. on April 29, 2020, unless later extended by a future Executive Order.”
